Tell me more about mediation and what it can do for me?

Mediation is a process that enables an impartial third party to help you to resolve your differences.

Mediation is otherwise known as Alternative Dispute Resolution.

Mediation can be used for many different types of disputes including marriage, family issues, work related, business, community, neighbourhood, victim offender and contractual disputes.

Mediation is voluntary, confidential and without prejudice, which means that whatever is said within the mediation process cannot be used against you in court. However our mediators do have a duty to report any instances where there is a concern about a child being put at risk or acts of terrorism.

Mediation can save lots of time, money and distress of going to court.

Mediation is very successful in most cases; mediators don't take sides or make judgements as they are trained to a very high standard to help you to reach a common sense settlement agreeable to both parties in a case.

How much does mediation cost?

The cost of mediation very much depends on the complexity of the dispute and how long the mediation process takes.  Mediation costs £50.00 per hour plus £50.00 per hour for any extra work that the mediator has to do for and outside of the mediation session, such as the initial meetings and any research that may be required.  Venue and or travel expenses are charged at cost.  This is considerably cheaper than legal fees.  Most mediations are completed in just a few hours

What are the main benefits of Mediation?

Mediation can be quicker, less stressful and cheaper than going to court. Once a settlement has been reached a mediation agreement can be drawn up.

Generally only agreements that relate to disputes already subject to Court proceedings can be enforced. The Court charges for this and there is no guarantee that the enforcement will be effective.

In practise however, parties tend to keep to the mediation agreement because they have prepared the terms themselves.

Mediations are completely confidential and the information discussed within them cannot be used in Court or in any other legal action issued at a later date

What next?

If both parties feel that mediation is the right approach to take then Crown Mediation will forward an agreement to you for completion. Once the agreement has been returned a date will be set for the initial meetings and mediation session.
